MySANY Service Agreement
SANY Global Customer Portal (MySANY) service (hereinafter referred to as the "Service") refers to the equipment-related services provided by SANY Group Co.,Ltd.through mobile communication networks and mobile terminals. This Agreement is a valid contract between SANY Group and you regarding the use of the Service and related matters. Your logging in to MySANY is deemed that you have read, understood, and agreed to accept all the provisions of this Agreement and confirmed to take responsibilities for all the legal consequences arising therefrom.
Before confirming to accept this Agreement, you must carefully read and fully understand the entire content of this Agreement, especially the clauses regarding exemption from and limitation of liability, and separate agreements (if any) for subscribing to or using a service, and choose to accept such separate agreements or not. If you disagree with any content of this Agreement, or cannot accurately understand any terms thereof, please do not proceed.
I. User Qualification and Account
1. The users of MySANY should be natural persons with full capacity for civil conduct, or legal entities with the ability to independently assume legal responsibility. In the case of personal users with no capacity or limited capacity for civil conduct, transactions should be made under the guardianship of guardians. In the case of entity users with no ability to independently assume legal responsibility, transactions should be made under necessary authorization.
2. Before using MySANY, users should check their hardware and software setups to ensure a safe and secure operating state.
II. Terms of Use
1. You will use MySANY on a voluntary basis, and you will abide by related procedures, agreements, and transaction rules when you use the MySANY service.
2. You understand that the MySANY service, as an equipment-related service, is provided through mobile communication networks by SANY Group, and therefore situations such as login failures, slow webpage loading, communication delay and errors, temporary service interruption, as well as cancellation, suspension, and termination of services may occur due to failures in networks or communication lines, power failures, power outages, or other factors beyond SANY Group's prediction and control. In case of the above-mentioned situations, services on MySANY will be resumed for you after the unexpected factors disappear. SANY Group shall not be held liable for any losses you suffer due to the above-mentioned unpredictable and uncontrollable factors or other reasons not attributable to SANY Group.
3. You can download MySANY client software from any third party legally authorized by SANY Group. Do not download and use any client software from unknown sources. If you obtain any setup program bearing the name of "MySANY" or a similar name from any third party not legally authorized by SANY Services, SANY Services cannot guarantee the normal use of the program, and the resulting consequences shall be borne solely by you.
4. The MySANY client software is available in two versions: the iOS version and the Android version. You should choose the version supported by your terminal device.
5. You understand and agree that: MySANY will use resources such as the processor and bandwidth of your terminal device in order to provide you with effective services. When using MySANY, you may incur data traffic costs. In this regard, you need to check with your mobile network operator about the relevant tariff and bear the relevant costs yourself.
6. You guarantee that the information provided to SANY Group is true, legal, valid, and complete. If the Service is unavailable or any error occurs due to your failure to provide true, legal, valid, and complete information or promptly notify SANY Services of any changes to the information, the consequences arising therefrom shall be borne solely by you. If SANY Group has reasonable grounds to suspect that the information you provide is false, illegal, invalid, or incomplete, SANY Group shall be entitled to refuse, suspend, or terminate the provision of the Service to you. In this case, SANY Group shall not be held liable, and you will bear the responsibilities and losses arising therefrom.
7. You are responsible for proper custody of devices and information related to the Service, including your account, password, one-time password token, identification number, mobile phone, and mobile phone number. All the transactions made with the above information are deemed that be made by you. For any risk or financial loss as a result of your losing control over the above-mentioned information, the consequences and responsibilities shall be borne solely by you. Confirmation of your transaction information is subject to the data recorded in the SANY Group system (unless there is conclusive evidence to prove that the records in SANY Group system are incorrect). You acknowledge the authenticity, accuracy, and legality of the data recorded in the SANY Group system.
8. You are not allowed to use the MySANY service to engage in violations or illegal activities, including but not limited to fraud. SANY Group shall be entitled to suspend or terminate the provision of the App service to you or take other reasonable risk control measures if it has reasonable grounds to suspect that you have committed violations or illegal activities.
III. Statement and Commitment
1. You acknowledge and agree that: SANY Group has the right to upgrade and modify the App system and adjust the functions, content, and formats of the App service as its business develops, in order to improve the service content and user experience.
2. SANY Group has the right to revise this Agreement for reasonable causes, such as laws, regulations, policies, system upgrades, and business development needs. You can check relevant agreement terms through the latest version of the SANY Group App. Upon revision of this Agreement, if you continue using MySANY, it is deemed that you have thoroughly read, understood, agreed, and accepted the revised agreement. If you do not accept the revised agreement, you should stop using MySANY.
3. When you register an account or use the Service, you need to provide SANY Group with necessary information, including but not limited to the following: your mobile phone number, which is required for the account registration service and user identification; your geographical location information, which is required for the Branch Features service; your permission to access phone messaging, which is required for SMS-based sharing; your permission to access phone calls, which is required for calling stores or customer service centers; your permission to access camera and microphone, which is required for face authentication; your permission to access NFC, which is required for the payment function; your permission to access phone clipboard, which is required for some function wizards; and your real-name identity information, which is required for some other services as specified by national laws, regulations, or policies. If the information you provide is incomplete or you fail to provide relevant information as required by SANY Group, your access to relevant services will be denied or restricted.
4. You agree that: in order to protect your transaction security and prevent your account from infringement, when using the MySANY service, you authorize SANY Services to collect, transmit, analyze, save, and use your personal information such as your name, credential, bank card number and mobile phone number, as well as equipment information such as your equipment model, quantities of SANY service SMS and call logs, quantity of application lists, operating system, unique device identifier, network access mode and type, and IP address. You also authorize SANY Services to inquire from, use with, and provide to legally established telecom operators and other organizations (including but not limited to China Telecom, China Mobile, China Unicom, and other external partners) relevant information, including but not limited to information about your mobile phone number, geographical location, behaviors, and equipment.
5. SANY Group collects and uses your personal information for the following purposes:
(1) Helping you become a user of the C-end APP. In order to obtain the Service, you need to provide your mobile phone number and email address, and create a user name and password. If you only use basic functions such as browse and search, you do not need to register as a user and provide the above-mentioned information. In order to obtain personalized services, during registration, you may supplement your personal information with the following additional items: your real name, gender, date of birth, place of residence, and your profile picture. If you do not provide this information, your access to personalized services will be affected. However, this will not affect your access to basic functions such as browse, search, and viewing equipment.
(2) Displaying and recommending products and services for you. In order to improve the products and services of SANY Group and provide personalized services, we will extract your personal features, such as your browse and search preferences, behavioral habits, and location information, based on your browse and search history, equipment information, location, intention, and orders, and we will push information or provide personalized services to you based on these personal features.
6. SANY Group will encrypt all the stored and transmitted information through professional and technical means to ensure the security of your personal information. SANY Group promises that it will not provide or disclose your personal information to any third party without your permission, except for the circumstances stipulated by laws and regulations or agreed in this Agreement.
7. You allow and authorize SANY Group to inquire from, use with, and provide to legally established credit reporting agencies and other relevant legal organizations your credit and asset information when SANY Group conducts credit business, such as loans or guarantees, with you. SANY Group shall undertake confidentiality obligations for your relevant information in accordance with laws, and promises to oblige its partners to keep your relevant information confidential.
8. You have the right to uninstall the MySANY software, and the Service terminates when you finish uninstalling the MySANY software. If you violate this Agreement or relevant procedures and business rules, SANY Group is entitled to unilaterally suspend or terminate the provision of the App service to you, and reserves the right to hold you accountable. Upon suspension or termination of the Service, the transaction instructions you sent to SANY Group before the suspension or termination shall remain in force, and you shall bear the consequences thereof.
IV. Limitation of Liability
1. Under no circumstances shall SANY Group be held liable for the failure or delay of performance caused by normal Internet equipment maintenance, Internet connection failures, failures in computer, communication system, or other systems, store failures, strikes, revolts, riots, catastrophic weather (such as flood and storm), fire, explosions, wars, government actions, orders of judicial administrative organs, or inaction of third parties (hereinafter collectively referred to as "force majeure").
2. If the system of MySANY crashes or fails to function properly due to the above-mentioned force majeure or other reasons beyond the control of SANY Group, resulting in loss of relevant information and records, SANY Group shall not be held liable. However, SANY Group shall take reasonable measures to assist in dealing with the aftermath, and make efforts to protect customers from financial loss.
3. Considering the particular nature of the Internet, you acknowledge and understand that the information displayed on MySANY is subject to delay and errors. You must distinguish the true from the false by yourself and exert caution to prevent risks.
V. Miscellaneous
1. Any dispute arising between you and SANY Group shall first be resolved by both parties through negotiation. If negotiation fails, a lawsuit may be submitted to the court with jurisdiction over the region where SANY Group is headquartered.
2. If any provision of this Agreement is found to be partially invalid or unenforceable for any reason, the validity of other provisions of this Agreement shall not be affected.
3. Matters not covered in this Agreement shall be handled in accordance with laws and regulations, relevant business rules of SANY Group.
